STOCKings (the “Software”) is a desktop app developed by Yu-Hao Yeh (the “developer”, “we”) for recording and organising your own investment records.
By installing or using the Software or this website you agree to these terms. If you do not agree, do not install or use it.
1.Licence
The Software is proprietary, not open source. Copyright belongs to the developer; all rights reserved. The developer grants you a non-exclusive, non-transferable licence, which may be ended only as set out in section 9,
to install and use the Software on your own devices to manage your own investment records.
Without prior written permission you may not: distribute, rent, lend, sell or sublicense the Software; modify, translate or create derivative works;
reverse engineer, disassemble or decompile it (except where the law expressly permits and this cannot be excluded by contract); use it to provide a service to others or build a competing product; or remove copyright notices.
The full licence is the licence agreement shipped with the app (LICENSE; LICENSE.txt in the installer and portable version). Where these terms and the licence agreement differ on matters of the software licence, the licence agreement prevails; on all other matters these terms and the law apply.
2.Not investment advice
Profits and losses, returns, fees and taxes, backtests, charts and AI summaries shown by the Software are for bookkeeping and portfolio reference only. They are not investment, tax, accounting or legal advice,
nor a recommendation to buy or sell any financial product. Rely on your broker statements and official data for investment decisions and tax filing; those decisions are yours.
3.Accuracy and timeliness of data
Prices, exchange rates, corporate actions and fundamentals come from third-party sources (such as the Taiwan Stock Exchange, Taipei Exchange, Taiwan Futures Exchange, the Central Bank, Yahoo Finance and FinMind)
and may be delayed, interrupted, incomplete or wrong. The developer does not guarantee their accuracy, completeness or timeliness, and results may differ from your broker's or the authorities' figures because of the data or the calculation method.
4.Your records and backups
Your data is stored on your own device and belongs to you; you can export or delete it at any time.
You are responsible for the accuracy of what you enter and for backing it up regularly. The developer cannot recover lost data, passwords, backup passwords or recovery keys for you.
Cloud backups live in your own Google Drive and are managed by your own Google account.
5.Third-party services
Some features connect to third-party services. They are provided independently by each third party, and their availability, content, terms and privacy policies are governed by that provider; the developer cannot control whether they keep running or the quality of their data, but this does not affect any liability the developer has under law:
Google Drive for optional cloud backup, under Google's terms of service.
Data sources for public market data. Sources marked as personal use only may be used for personal purposes only.
AI providers for optional AI summaries and scheduled AI tasks, using the provider you choose and your own API key; their fees and usage rules are between you and the provider.
Broker APIs for optional live intraday quotes, using your own API key from your broker, under your agreement with the broker and its usage rules. The Software only reads quotes and cannot place orders; you are responsible for the key's permissions and safekeeping, and a quotes-only key is recommended.
How personal data is handled is described in the Privacy Policy.
6.Acceptable use
You agree not to use the Software for unlawful purposes; interfere with or disrupt the Software, its update mechanism or related services; scrape data sources beyond normal use in bulk or by automation;
or circumvent the Software's security or licensing mechanisms.
7.No warranty
To the extent permitted by law, the Software is provided “as is” and “as available”, without any warranty that it is error-free, uninterrupted, meets your needs or is fit for a particular purpose.
8.Limitation of liability and use risks
8.1 What the Software does
The Software is a tool for recording your own stock trades, managing your portfolio and calculating related financial figures, including but not limited to trade records, holding cost, realised and unrealised profit and loss, dividends and returns.
The Software only records and calculates from data you enter or import or that it retrieves. It does not give buy or sell recommendations, investment recommendations, asset allocation advice or any other investment advisory service.
All results are for your own records and reference only and are not professional investment, financial or tax advice.
8.2 Data and results
You are responsible for checking that the trade data you enter, import and maintain is correct and complete. The developer does not guarantee the accuracy, completeness, timeliness or continued availability of data you enter, data from third parties or external market information.
Results may differ from broker statements, financial institutions' records or other sources because of input errors, differences between data sources, calculation conditions, system limits or other factors.
You should check important trades and financial information yourself and not rely on the Software's results alone.
8.3 Limitation of liability
To the maximum extent permitted by law, the developer is not liable for indirect, incidental, special or consequential damages arising from the use of or inability to use the Software, including but not limited to investment losses, loss of expected profits, loss of business opportunities and other indirect damages.
To the extent permitted by law, the developer is not liable for damage caused by your input errors, failure to maintain or back up your data, third-party service failures, errors in external data sources or other causes not attributable to the developer.
You should keep and back up important trade records and related data yourself. The developer does not guarantee that the Software will be uninterrupted, error-free or that data will never be lost.
8.4 Exceptions
Nothing in this section excludes or limits any liability of the developer that cannot be excluded or limited in advance by law, including damage caused by wilful misconduct or gross negligence and any other liability that cannot be excluded or limited under applicable law.
9.Termination
You may stop using and uninstall the Software at any time. The developer may end your licence only in these cases:
Material breach: distributing, selling or sublicensing the Software, reverse engineering it, circumventing its security or licensing mechanisms (sections 1 and 6), or using it for unlawful purposes. The developer may end the licence immediately after notifying you.
Other breach: any other breach of these terms. The developer will first notify you and ask you to remedy it within 30 days; the licence ends only if it is not remedied in that time.
Discontinuation: if the developer decides to stop offering the Software or a service, this will be announced on this website and in the app's release notes at least 30 days in advance. Any paid but unused period is refunded according to the plan terms at purchase and the law.
Notices are sent to the contact details you gave the developer or shown in the app. When the licence ends you must stop using and delete all copies of the Software; your data remains yours and can be exported before and after termination.
Sections 2, 3, 4, 7, 8, 11 and 12 survive termination.
10.Changes to these terms
The developer may revise these terms. Revisions are posted on this page with a new effective date, and significant changes are mentioned in the app's release notes. These terms have their own version (see the footer). After a material revision the version changes and the app asks you to read and accept it again the next time you open the app and sign in to your account on this computer; if you decline you are only signed out, your data is not deleted, and you can uninstall the app.
When you accept, the app records the document, version and time in the database on your computer, and the developer keeps the full text and effective date of every version on this website. If a registration or paid service is offered later, that service will also record your acceptance.
11.Governing law
These terms are governed by the laws of the Republic of China (Taiwan). The Taiwan Taipei District Court has jurisdiction in the first instance over disputes arising from them, unless mandatory law provides otherwise.
